The within-described puppy is guaranteed to be in good health, to the best of Seller’s knowledge, at the time of the sale.
Initial Guaranty Period: As a condition to this Guaranty, Seller has instructed the Buyer to have the puppy checked by a licensed veterinarian (within 72 hours of purchase). THE PUP IS TO BE CARRIED OR CRATED FOR THE VETERINARY VISIT AND IS NOT TO BE ALLOWED TO WALK THROUGH THE VETERINARIAN’S OFFICES. THE PUP THAT CAME IN JUST BEFORE YOU COULD HAVE BROUGHT THE PARVO VIRUS IN WITH IT. If the veterinarian finds anything that is LIFE THREATENING with the puppy, it will be exchanged for another puppy of equal value, provided a letter from the examining veterinarian is offered as evidence of the puppy’s illness, and the puppy is returned within the guaranty period (or acceptable arrangements have been made with the Seller). If it has been determined that, despite Seller’s best efforts, the pup left Seller’s premises with some type of virus or infection or minor illness, Seller agrees to share in the (reasonable) expense of veterinary care, up to the whole thereof PROVIDED THE BUYER HAS CONTACTED BREEDER IMMEDIATELY THAT THE PUP IS BEING TAKEN TO THE VET. Failure to have a vet check will void this guaranty. Certain illnesses, such as parvo, giardia, chlostridia and coccidia, are highly contagious and easily passed to the pup from other animals or the environment. The incubation period for such illnesses is approximately three to seven days from the date of exposure. Therefore, the guaranty for reimbursement will cover the pup for these illnesses for a period of seven (7) days from the date the pup goes home. Any signs of lethargy, lack of appetite or desire to drink water, diarrhea (particularly with blood and/or mucous), or vomiting must be reported to the breeder and your vet immediately.
Buyer understands that Seller has instructed Buyer not to take puppy to public places (including, but not limited to, parks, neighbors’, Petsmart or other pet stores, puppy classes/training, etc.) until the puppy has received his/her final rounds of shots (16 weeks of age). This is for the health of the puppy and to avoid contact with areas where infected or un-vaccinated dogs may have been or may be present with such illnesses/bacteria/fungus causing parvo, giardia, chlostridia, coccidia, etc. might be present. This is to protect the puppy, and could save the puppy’s life. Any illness contracted from Buyer’s decision not to follow these guidelines will void this guaranty.
Twenty-Four Month Guaranty Period: In the event of an emergence of any genetic disorder within the first 24 months of the dog’s life which is sufficiently serious to greatly diminish the quality of your pup’s life, Seller agrees to replace the pup with one of equivalent quality from a subsequent litter bred by the breeder, or Buyer may elect to receive one-half the purchase price (not including shipping charges). (Proof to be provided to Seller.) Shipping, if necessary, of said replacement pup shall be at Buyer’s expense. If the genetic disorder is hip displaysia, the x-rays must be submitted for review by OFA, and the dog shall NOT HAVE BEEN OVERWEIGHT AT ANY TIME DURING THE GUARANTY PERIOD.
Except as set forth above regarding the 72-hour guaranty, you will never be asked to return your pup/dog in order for this guaranty to be effective.
Buyer agrees to maintain this dog in good health, provide routine preventative health care including, but no limited to, inoculation, parasite control, heartworm prevention, and preventative medication; failure to do so voids this guaranty.
NOTE: Not included in this guaranty are health problems arising from trauma, abuse or failure to maintain general health care of this dog (including allowing the dog to become overweight). Also not included is injury to joints or bones from over-exercise. Veterinary records must be provided to Seller if requesting refund or replacement. Under no circumstances shall the Seller be liable to the Buyer or to any third party for a dog that has been subjected to abuse, accident, negligence, or misuse. Also, under no circumstances shall the Seller be liable for any consequential, incidental, or special damages resulting from or in any manner related to this dog.
If for any reason the pup has not been spayed/neutered prior to pick up, Buyer agrees to spay or neuter the pup before it reaches the age of six (6) months. Failure to do so will void this guaranty.
Re-Homing: If an unforeseen situation arises such that Buyer is unable to continue to keep the puppy/dog, Buyer agrees to contact Seller and Seller will take the puppy back and find an approved home for such pup/dog. (Delivery arrangements are responsibility of Buyer.) If Seller is able to sell the pup/dog, Seller will provide the sale price of the dog to the Buyer, less $100 re-homing fee or actual expenses, whichever is greater. Buyer understands that the sale price of the pup/dog will not necessarily be the same price as Buyer paid for the pup/dog, depending upon the pup/dog’s marketability at the time of re-homing. Seller offers this re-homing so that no pup/dog bred by Seller ever ends up in a shelter or in an un-approved home.
This guaranty is not transferable and is between the Seller and the original Buyer only.
It is further understood and agreed that no warranty or representation has been made with respect to the sold puppy except as set forth herein. This guaranty is void if this agreement is not signed and postmarked (either by U.S. postal mail or email) within 10 days of its receipt.
